Terms of Service

NB! My works such as visual arts, artistic or journalistic texts are protected by the copyright law.  I do not give permission to use them for machine learning, neural networks training, AI-image generators or applications powered by AI/ML neither to my customers, nor to anyone else. If you discover my works in any datasets, that are used to train any Ai/Ml image generators, text models or chat-bots, know, that it is a copyright law violation and is done against my will.

Art commissions terms of service

By filling the Commission Inquiry Form and/or paying the invoice for a commissioned piece you automatically agree to the following terms and conditions:

Artwork (or a series of artworks) may be commissioned by private individuals, groups, and companies working on non-commercial projects. All the prices are listed in Commission Inquiry Form. Commercializing the commissioned artworks is possible by paying a fee (see the information below).  

General information:

• Personal (non-commercial) use;

• Digital goods only; no shipping required.

Payment information:

• Payment in US Dollars/Russian Rubles;

• No refunds;

The commissioner’s rights:

• All the rights on the depicted characters, locations or items belong to their rightful owner. The commissioner remains the one and only owner of their original characters,  original settings and other creations depicted on a commissioned piece;

• Any personal (non-commercial use) is allowed. The commissioner is free to use the commissioned piece/character design in any non-commercial manner, including personal projects (such as: free-to-play videogames, literary creations*, free music albums under Creative Commons license and etc).

• Creating physical copies of the commissioned piece and printing it on any physical objects is allowed as long as it is done for non-commercial purposes.

• Turning the commissioned artwork into an NFT is strictly prohibited.***

• The commissioner is free to repost the commissioned piece anywhere online, giving a credit to the author.

• To commercialize the commissioned artwork/character design paying a fee (+100% of the total price) is required, as well as giving a credit to the author in any suitable manner (for example, putting the authors nickname in the videogame end credits).

• The commissioner is free to post the censored version of a commission containing nudity anywhere they pleases, giving credit to the author. Posting the uncensored version is not prohibited but not endorsed.

• Editing and alteration (such as: cropping, repainting, coloring and etc.) is prohibited.

• Animating the piece is allowed**;

The authors rights:

• The author owns the copyright for every commissioned artwork they created;

• The author reserves the right to post (or not) all the finished commissioned pieces on their social medias;

• The author reserves the right to post the high resolution files, WIPs, timelapse videos on Patreon or similar websites;

• The author reserves the right to post the timelapse videos on Youtube and other video hostings, giving all the credits to the commissioner/depicted characters’ owners.

• The author reserves the right to use the commissioned pieces for self-promotion (examples: banners/announcements at conventions);

• The author reserves the right to refuse working on the commission without the explanation (ONLY before the sketch is approved and the prepay is proceeded);

• The author will not provide the commissioner (or anyone else) the original file in .psd;

General rules:

• References and text descriptions are always required, mo matter which subject is supposed to be depicted on the commissioned piece; 

• Painted (rendered) pieces requires references of the facial structures: photographs or 3D-model of your character/ a person with similar facial features or an AI-generated realistic image of your character.

• The commission inquiry is automatically rejected if it contains these themes and subjects:

Mecha/robots, animals, anthropomorphic animals and furries, real people, gore, any depictions of sexual harassment, torture and other physical abuse****, explicit content and political content, military related themes, aesthetics and symbols*****;

• If the commissioner is underage it is automatically supposed that they have parental concern;

• If artistic nudity or pinup content is requested, the commissioner must be 18 years or older.

• All the commissions are put on Waiting List. The commissioner has a right and an opportunity to check the waiting list at any time;

• The commissioner gets the high resolution file of the commissioned illustration/character design as soon as the full payment proceeds;

Additional fees:

• Extra characters (+100% of price for each additional character);

• Detailed backgrounds;

•  Commercial use (+100% of total illustration and/or character design price);

Exceptions:

Using the non-commercial commissioned piece as a cover illustration for novels, fanfiction and other literary creations monetized through patreon or similar services with the paywall is not considered a commercial use. However, selling the physical copies and/or digital versions of the book with the commissioned cover and/or illustrations is considered a commercial use.

** Animating the commissioned piece is automatically allowed as long as it remains SFW. If animating an not safe for work piece is required, please contact the artist for clarifications.

*** Doing so you get automatically banned from commissioning the artist forever. The artist also reserves the right to inform the general public of the commissioner monetizing the copyrighted images. 

**** Except fencing, sparring and fighting characters and any other examples of the fair fight.

*****This rule applies to all the historical military uniforms and gear from WWII to modernity. This doesn't apply to medieval, steampunk, dieselpunk, cyberpunk and futuristic weapons and armor, as well as historical military uniforms of early XX century and earlier.

Adoptable characters terms of use

By paying an invoice for an adoptable character you automatically agree to the following terms and conditions:

Adoptable characters are character concepts created by the author themself (non-commissioned). The adoptable characters can be purchased online as digital goods, which includes:

• Character idea and/or brief backstory;

• Character design;

• Reference sheet and/or detailed illustration depicting the design and containing main information on the said character.

General information:

• Commercial and non-commercial use;

• Digital goods only; no shipping required.

Payment information:

• Payment in US Dollars/Russian Rubles;

• No refunds;

The buyer’s rights:

• Any personal and commercial use is allowed. The commissioner is free to use the purchased character design in any manner, including personal and commercial projects;

• If the purchased character is used in commercial projects crediting the original author in any suitable manner is required;

• The buyer is free to create and commission any SFW-content depicting the purchased character;

• The buyer is free to create and commission other artists any kind of content depicting the purchased character, explicit content included, but only as long as the character is 18 years old and above (and it’s design shows the signs of physical maturity);

• Character design can be mildly altered by the buyer or any artist commissioned to do a redesign: for example the color scheme or body type can be changed if necessary. There is no limit on details that can be added on top of the original character’s design.

• Turning the reference sheet/illustration created by the original design author into an NFT is strictly prohibited.

• The purchased adoptable character’s name and backstory can be changed; however, the character's race/species can not.

• Reselling the purchased character design is prohibited. However, the character can be gifted or given away by the buyer, if they decide so.

• The buyer has no rights to create other characters of the same species if that is an original species created by the author, unless the permission is given.

The authors rights:

• The author owns the copyright for an original artwork and/or reference sheet of the purchased adoptable character, but not the character itself;

• The author reserves the right to post the original artwork/reference sheet on their social media and/or portfolio as an example of their design work.

• The author reserves the right to post the high resolution files of an original illustration/character sheet of the purchased characters, WIPs, timelapse videos on patreon;

• The author reserves the right to post the timelapse videos on youtube channel;.

• The author reserves the right to use the original illustrations/reference sheets of the adoptable character for self-promotion;

• The author will not provide the buyer (or anyone else) the original files in .psd;

• The author has an exclusive right to create other adoptable characters and/or commissioned character designs of the same species as the purchased one, especially  if it is the original species created by the author.
